FY2025 States used these funds to conduct a wide array of programming to include highly visible enforcement programs for seat belt and child seat law violations, impaired drivers, and other highway safety issues to deter unsafe driving behaviors. Funds are also provided for programs in motorcyclist safety, bicycle and pedestrian non-motorized safety, and other safety programs based on the state’s problem identification.

Program Objective

The State and Community Highway Safety funding program is administered by the National Highway Traffic Safety Administration (NHTSA) at the Federal level and by the State Highway Safety Offices (SHSO) at the State level. The formula grant funding facilitates a coordinated national highway safety program to reduce traffic crashes, deaths, injuries, and property damage. Each State may use these grant funds only for behavioral highway safety purposes to improve traffic safety for travelers using public roadways. At least 40 percent of these funds are to be used by political subdivisions of the State to address local traffic safety problems.

Award Procedure

Formula grant awards for the State and Community Highway Safety Programs are determined by statutory formulas. Eligibility and compliance determinations are made by NHTSA Regional Administrators.

Decision Timeline

  • Approval: From 30 to 60 days

NHTSA is provided up to 60 days to review and approve Triennial Highway Safety Plans and Annual Grant Applications.

Description

Section 402 funds are authorized by Congress and are available to the 50 States, Puerto Rico, the U. S. Territories and the Bureau of Indian Affairs acting on behalf of the Federally recognized tribes. These funds are apportioned using statutory apportionment formula. These funds are provided to the State and Territorial Highway Safety Offices based on an approved Triennial Highway Safety Plan that details problem identification, performance measures, countermeasure strategies for programming funds and an approved Annual Grant Application that details planned projects using identified countermeasure strategies for programming funds to help reduce crashes, injuries and fatalities resulting from motor vehicle crashes.

Allowed Uses

Formula grant funds may be used for behavioral traffic safety problems identified by the State to improve highway safety for travelers utilizing public roadways. The law provides that at least 40 percent of these Federal funds apportioned to a State for any fiscal year will be expended by the political subdivisions of such State.

Required Documentation

Performance plan approved by the agency is required and Triennial Highway Safety Plan, Annual Grant Application, certification statement, and Program Cost Summary. July 1 is the due date for the State Triennial Highway Safety Plans. August 1 is the due date for the State Annual Grant Applications for the formula grant program. 2 CFR Part 200, Cost Principles. 2 CFR 200, Subpart E - Cost Principles applies to this program.

Matching Requirements

Federal share shall not exceed 80 percent or applicable sliding scale.
