Program Objective
To assist organizations that are regional and local, community based, and National, that develop, implement, carry out, or coordinate programs and/or activities to prevent or eliminate discriminatory housing practices as prohibited by the Fair Housing Act (42 U.S.C. 3601-3619), or State or local laws that provide substantially equivalent rights and remedies for alleged discriminatory housing practices.

The non profit organization eligible applicants are: Qualified fair housing enforcement organizations, other private nonprofit fair housing enforcement organizations, and nonprofit groups organizing to build their capacity to provide fair housing enforcement, for the purpose of supporting the continued development or implementation of initiatives which enforce the rights granted under title VIII of the Civil Rights Act of 1968 [42 U.S.C. 3601 et seq.], as amended.

The date range for approval/disapproval ranges from 120 to 180 days. The final decision rests with the Assistant Secretary for Fair Housing and Equal Opportunity or her/his designee.

Use of Funds
Allowed Uses
Financial assistance shall be used for nonprofit groups organizing to build their capacity to provide fair housing enforcement, for the purpose of supporting the continued development or implementation of initiatives which enforce the rights granted under title VIII of the Civil Rights Act of 1968; or to help establish, organize, and build the capacity of fair housing enforcement organizations, particularly in those areas of the country which are currently underserved by fair housing enforcement organizations as well as those areas where large concentrations of persons with protected characteristics exist. Projects and activities must be fair housing related projects. Eligible projects and activities must be conducted in accordance with procedures contained in 24 CFR Part 125 and the NOFO. Funds may not be used for purposes of settling claims, satisfying judgments, or fulfilling court orders in any litigation action involving either the Department or housing providers funded by the Department. Funds may not be used by the Department for administrative costs. Funds may not be used for payment of expenses in connection with litigation against the United States. Funding is based on congressional appropriations.
Required Documentation
Applicants must submit applications in accordance with the Notice of Funding Opportunity (NOFO) criteria including specific HUD Forms/Assurances/Certifications, narrative Rating Factor responses, Statement of Work and Budget, and an eligibility certification. Applicants must adhere to costs as determined by 2 CFR 200.400 (Subpart E – Cost principles).
